Acceptance of the Terms of Use

Please note that your access and use of the Website www.axessorize.com, hereinafter the Axessorize, is subject to the terms and conditions of use set out below, hereunder Terms of Use. These Terms of Use apply between you and Distribution Axessorize Inc., and are in addition to any other terms and conditions that may apply to certain parts or features of the Site, including contests, promotions or other similar features, such conditions being incorporated into these Terms of Use.

By using the Site, you are deemed to have read, accepted and acknowledged the validity of these Terms of Use. You commit to respect them and to be bound by them.

Any modification to the Terms of Use, products or services offered on the Site shall enter into force upon publication of these modifications on the Site. If you continue to use the Site after publication of the changes, you are deemed to have accepted the changes.

No provision contained herein shall be construed as conferring, by implication or otherwise, any licence or right under any copyright. You may use the information solely for your own personal use, provided that you refer the respective copyrights, notices and trade-marks on the copies. Unless otherwise specified, the information may not otherwise be copied, displayed, distributed, downloaded, licensed, modified, published, reproduced, reused, sold, transmitted or used for derivative, public or commercial purposes without the express written consent of Distribution Axessorize inc.

Usage of the Site

• modify or change the Site or any part thereof, as well as any policies or provisions relating thereto; and
• interrupt the operation of the Site or part of the Site as necessary to perform regular or irregular maintenance, error correction or other changes.

Accounts, passwords and security

Certain services and features offered on or through the Site may require the opening of an account, the configuration of a username and a password. It is your responsibility to implement and maintain safeguards and security measures to protect your username and password against unauthorized use. Upon request, you agree to attend and reasonably accompany Distribution Axessorize inc. in its efforts to stop and / or correct any security breach.

By accessing and using the Site, you acknowledge that Distribution Axessorize inc. may collect your personal information to provide you with products or services, to process credit card payments or other, to inform you about the products and services offered or for any other reasonable purpose and in connection with the business activities of Distribution Axessorize inc.

Liability limitation

In no event will Distribution Axessorize Inc., its affiliates or their respective representatives, agents, dealers, distributors, resellers or suppliers, collectively referred to as "Axessorize Distribution Entities Inc." be liable for any direct, indirect, special, consequential or punitive damages or any other damages or losses whatsoever, including in particular loss of profits, goodwill, opportunities, the revenues, the use of information and resulting or being directly or indirectly related to these Terms of Use or the Site, regardless of the reason for action, and even if one or more Axessorize Distribution Entities inc. had been advised of the possibility of such damage or loss.

Governing law and jurisdiction of the courts

Any questions or disputes relating to access to the Site or its use are governed by and interpreted according to the laws and regulations in force in the province of Quebec in Canada.

Courts of the Province of Quebec have exclusive jurisdiction to hear and decide any dispute arising from access to the Site, use of the Site or interpretation of these Terms of Use.

Miscellaneous

The terms presented in the singular form include the plural form and vice versa, the term "person" includes individuals, corporations, partnerships, associations, trusts, individual companies, government agencies and other legal and commercial entities.

In addition to these Terms of Use, other terms and conditions may apply to the purchase of products and services, as well as to certain parts or functionality of the Site, including contests, promotions or other similar features, such conditions being incorporated into these Terms of Use. You agree to abide by these other terms and conditions, including the confirmation, if applicable, that you are of legal age to use or participate in the service or feature. In the event of any inconsistency between these Terms of Use and the terms published in any given section of the Site or for any services offered on or by the Site, or that apply to them, these latter terms shall prevail and govern the use of this section of the Site or of the concerned service.

These Terms of Use present all the rights and obligations binding Distribution Axessorize inc. and any user of this Site. They replace any prior terms or previous provision relating to the use of this Site. No verbal or written statement from Distribution Axessorize inc. may have the effect of modifying or substituting for these conditions.

All sums of money provided for in these Terms of Use are in Canadian currency.

The titles used in these Terms of Use have no interpretative value. Their only function is to facilitate the reference to the provisions of the Terms of Use.

Unless otherwise indicated, when the Terms of Use require the approval, opinion, authorization or consent of Distribution Axessorize inc. or a third party, it must be in writing.
